1. General
These Rental Terms (“Terms”) govern your use of the justmac.app website and the JustMac remote Mac rental service (“Service”). The Service is provided by JustMac (“we”, “us”, “our”).
By creating an account, paying for a rental or otherwise using the Service, you confirm that you have read and accept these Terms, the Payment Terms, the Refund Policy and the Privacy Policy. Together they form the agreement between you and us. If you do not agree to them, do not use the Service.
If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms on its behalf, and in that case “you” means that organisation.
2. Definitions
- Mac means a physical Apple-branded computer (MacBook Air, Mac mini, Mac Studio or another model) hosted by us in Australia, together with the macOS operating system installed on it.
- Rental means the provision to you of remote access to a selected Mac for a paid period.
- Rental Period means the paid rental period: a day (24 hours), a week (7 days) or a month (30 days), and each renewal period.
- Session means a connection to a Mac through a web browser.
- Account means your user account with the Service.
- Your Data means files, software, code, credentials and any other information that you place on a Mac or process using it.
- Australian Consumer Law means the Australian Consumer Law set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
3. Your account
- You need an account to rent a Mac. You can sign in with Google, Apple, Facebook, GitHub or an email address.
- You must be at least 18 years old and have legal capacity to enter into contracts.
- You must provide accurate information and keep it up to date. We send receipts and notices to your account email address.
- You are responsible for keeping access to your account secure and for all activity carried out through it. Do not share access with anyone else.
- If you suspect that someone else has gained access to your account, email hello@justmac.app immediately.
4. What the rental includes
- Remote access to the selected Mac model for the paid period through a modern web browser. You do not need to install any software on your own computer.
- For the entire Rental Period the Mac is provided to you alone: other users of the Service have no access to it.
- The minimum Rental Period is 24 consecutive hours.
- Our Macs are hosted in Australia. Performance depends on your internet connection and your distance from Australia.
- Before each Rental the Mac is erased to its factory state, and it contains no data from previous users.
- The Mac is prepared by us: it has an administrator account for you (its name and password are shown on the site), the JustMac service agent and our device management (MDM) settings. The agent lets you control the Mac from your browser and sends us technical readings (load, temperature, disk and network use); it does not read your files, screen, clipboard or keystrokes. Find My, Location Services and Wi-Fi are turned off, the speakers are muted and the microphone input is set to zero. The agent and these settings are part of the Service and are governed by these Terms.
- We may carry out technical maintenance of the hardware and system (administration) without accessing the contents of your files, except as described in the “Your Data” section.
- If a Mac becomes faulty, we may replace it with the same or a more powerful model. Your Data may not be preserved in that case.
5. macOS licence and acceptable use
Each Mac is provided with macOS, which is licensed by Apple Inc. Apple’s terms permit Macs to be leased only for software development purposes. Accordingly:
- You may use the Mac only for software development and testing: writing and building code, automated testing, continuous integration (CI), signing and publishing apps, and using the developer tools required for these purposes.
- Before you start using the Mac, you accept the macOS software licence agreement and must comply with it.
- Software that you install yourself (for example, Xcode or apps from the App Store) is installed under your own Apple Account and used under its own licence terms.
- The Mac may be controlled from only one device at a time. A new connection to a Session disconnects the previous one.
- The JustMac service is not affiliated with, endorsed by or sponsored by Apple Inc.
6. Prohibited use
You must not:
- use the Mac for purposes unrelated to software development and testing;
- breach the law, the rights of third parties or software licences, including by distributing unlicensed software;
- send spam, carry out attacks, scan third-party networks and systems, or host malicious software;
- mine cryptocurrency;
- give third parties access to the Mac, resell it or sublet it;
- attempt to access other Macs, our infrastructure or other users’ data, or circumvent the Service’s restrictions;
- modify the firmware or hardware security settings, unless this is required for development and agreed with us;
- create load that interferes with the operation of the Service for other users.
If you breach these rules, we may suspend or terminate your Rental in accordance with the “Suspension and termination” section.
7. Rental Period and renewal
- The Rental Period begins when payment is confirmed and runs continuously, whether or not you are connected to the Mac.
- You may renew a Rental at any time before the end of the Rental Period, in the session panel or in your account. The renewed period is added to the current one. For one hour after the Rental Period ends you can still renew — from the email we send you or the Mac’s session page — and keep your data; the renewed period then starts when you pay.
- Auto-renewal is off by default. You can turn it on at checkout and turn it off at any time in your account. While it is on, at the end of each Rental Period the card you paid with is charged, through Paddle, for the next period of the same length, at the price applicable at that time.
- If auto-renewal is off, we will send you a reminder 24 hours before the end of the Rental Period. If the Rental is not renewed, access to the Mac ends at the end of the Rental Period.
- For more about payment and renewal, see the Payment Terms.
8. Prices and payment
- Prices are shown on the Prices page in US dollars (USD). The total amount is displayed before you pay.
- Rentals are paid in advance. How to pay, taxes, receipts and what happens if a payment fails are described in the Payment Terms.
- We may change our prices. A new price does not apply to a Rental Period that has already been paid for. We will notify you in advance of any price change that affects auto-renewal you have turned on.
9. Availability and maintenance
- We use reasonable efforts to keep the Service running without interruption, but we cannot guarantee that it will be entirely free from outages: its operation depends on hardware, hosting, power grids, the internet and third-party services.
- Where possible, we give advance notice by email or in the session panel of scheduled maintenance that interrupts access to a rented Mac.
- If a Mac was unavailable through our fault, you are entitled to an extension of your Rental or a refund for the lost time, in accordance with the Refund Policy and the Australian Consumer Law.
10. Your Data
- Your Data belongs to you. We acquire no rights in it other than those needed to operate the Service.
- We do not view the contents of a rented Mac, except where required by law, at the request of an authorised government authority, to investigate a serious breach of these Terms or a security threat, or with your consent.
- One hour after a Rental ends, the Mac is erased to its factory state and all data on it is permanently deleted. Until then you can renew the Rental and keep your data. Data cannot be recovered after deletion.
- We do not back up Your Data. Save the files you need before the end of the Rental Period and make regular copies — for example, to Git or cloud storage.
- Do not store on the Mac any data that you are not entitled to process. If you process other people’s personal information on the Mac, you are solely responsible for complying with data protection laws.
11. Security
- We protect the Service with technical and organisational measures: encrypted connections, isolation of rented Macs from one another and complete wiping after each Rental.
- You are responsible for the security of what you do on the Mac: passwords, keys, certificates and the accounts you sign in to. Sign out of your accounts when you finish working.
- Please report any vulnerabilities you find to hello@justmac.app.
12. Suspension and termination
By you
- You may stop using the Service and turn off auto-renewal at any time. Your Rental will end at the end of the paid Rental Period.
- You can have your account deleted on request, as described in the Privacy Policy.
By us
- We may suspend or terminate your Rental and close your account if you have materially breached these Terms or the macOS licence, have breached the law, or if this is necessary to protect the Service, other users or third parties.
- Where it is reasonable and safe to do so, we will first warn you and give you an opportunity to remedy the breach. In the case of a serious breach, such as an attack or unlawful activity, access may be terminated immediately.
- If a Rental is terminated because of your breach, no refund is given for the remaining time, except where a refund is required by law.
- We may discontinue the Service or a particular Mac model by giving at least 30 days’ notice. In that case, we will refund the unused portion of the paid Rental Period.
After a Rental ends, the data on the Mac is deleted in accordance with the “Your Data” section.
13. Consumer rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that the law gives you and that cannot be excluded by contract.
14. Limitation of liability
To the extent permitted by law, including the Australian Consumer Law:
- Apart from the guarantees that cannot be excluded by law, we give no other warranties in relation to the Service, including any warranty of fitness for a particular purpose.
- To the extent the services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a guarantee that cannot be excluded is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
- We are not liable for loss of profit, loss of revenue, goodwill or opportunity, missed deadlines, rejection of your app by the App Store or other platforms, or any indirect loss.
- We are not liable for loss of Your Data after a Rental ends, or loss resulting from your actions, the actions of third parties for whom we are not responsible, or circumstances that we could not reasonably have prevented.
- We are not liable for the operation of third-party software and services, including macOS, Xcode, the App Store, sign-in services, the payment provider, your internet service provider and your browser.
- Our total aggregate liability under the agreement is limited to the amount you paid us in the 3 months preceding the event giving rise to the claim.
These limitations do not apply to liability that cannot be limited by law, or to loss or damage caused by our fraud, wilful misconduct or gross negligence.
15. Indemnity
If you use the Service for business purposes, you indemnify us against reasonable losses and costs, including reasonable legal costs, arising from claims made against us by third parties, to the extent that those claims are caused by your breach of these Terms, the macOS licence or the law. This does not extend to losses caused by our own actions.
16. Intellectual property
- The website, the Service software, design, text and the JustMac trade marks belong to us or our licensors. A Rental does not transfer any rights in them to you, other than the right to use the Service in accordance with these Terms.
- Apple, Mac, MacBook Air, Mac mini, Mac Studio, macOS, Xcode and other marks mentioned belong to their respective owners. They are referred to solely to describe compatibility and hardware.
- If you send us feedback or suggestions, we may use them to improve the Service without any obligation to you.
17. Third-party services
Third-party services are used for sign-in and payment: Google, Apple, Facebook, GitHub and the payment provider. Your use of them is governed by their own terms and privacy policies. We are not responsible for the operation of these services.
18. Changes to these Terms
- We may change these Terms, for example when the Service or the law changes. The new version is published on this page with its effective date.
- We will notify you of material changes by email at least 14 days before they take effect.
- A Rental Period that has already been paid for is governed by the version in force at the time of payment. If you do not agree with the new version, you may turn off auto-renewal and stop using the Service.
19. Disputes and governing law
- If you have a complaint, email hello@justmac.app. We will respond within 5 business days and will try to resolve the matter within 30 days.
- If the matter is not resolved, you may contact Consumer Affairs Victoria or the consumer protection agency in your state or territory.
- These Terms are governed by the laws of the State of Victoria, Australia. Disputes are to be heard by the courts of Victoria and the federal courts of Australia, unless the law gives you the right to bring proceedings in another court.
20. Miscellaneous
- If any provision of these Terms is held to be invalid, the remaining provisions continue in full force.
- If we do not exercise a right, this does not mean that we have waived it.
- You may not assign your rights and obligations under the agreement without our consent. We may assign them to a successor in the event of a restructure or sale of the business, provided your rights are preserved.
- We send notices to your account email address, and you send notices to hello@justmac.app. A notice is taken to be received on the day it is sent, unless a notice of non-delivery is received.
- We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control: natural disasters, power and telecommunications outages, actions of government authorities, or large-scale attacks. This does not limit your rights under the Australian Consumer Law.
